Wills & Estate Planning

Every family is different - and when you pass, you want to feel confident that those you love and care for most continue to be looked after long after you’re gone. Working with you to understand your wishes, a Will ensures that you do not leave anything to chance. There are things you can do now.

Our pricing is listed out further below and we offer FREE safe custody storage and FREE reviews.

  • This is the most common type of Will and provides for a main executor and an alternative and then gives your estate to a specific person (i.e. your spouse) and then alternatives (i.e. your children).

  • A Testamentary Trust is part of your Will (i.e. it is not a separate document) and comes into effect upon your death. It allows you to provide for people without allowing them direct access to what has been given to them.

  • A POA can either be a General or Enduring power and they are very different documents for very different purposes. Both need you to have legal capacity to enter into them and only one will continue even when you lose capacity to make your own decisions. Let us help you figure out which one you need and when.

  • An AHD is also sometimes referred to as a living Will. It gives directions about your future health care (i.e. what procedures or medication you do (or don’t) want administered if you aren’t able to choose at the time) for times when you have lost capacity and cannot make those decisions for yourself. Initially prepared with you and your GP (as the GP needs to sign the ‘Doctors Certificate’). It can also include an Enduring Power of Attorney). You can then bring it to us and we then make sure everything is completed properly and then sign the form as your witness.

  • Did you know your superannuation and life insurances do not automatically go into your Estate (i.e. your Wills)? The Trustee of those funds have a Trust Deed which sets out how the funds should be paid. However we can assist in making sure you nominate who you want the funds to go to, making it binding on the Trustee.

We can help with :

Your Will is not necessarily all about you - it is about ensuring that those that are left behind are provided for in a way that you want,

With Estate Planning it is not just about a Will that you may need - there are other documents to think about like an Enduring Power of Attorney or an Advance Health Directive, and you will also need to ensure that you deal with your Superannuation and Insurance policies as they do not automatically fall into your Estate when you pass.

Things to keep in mind

1.      Gather & Educate - use our nifty online questionnaire to provide all your details and information, as well as being educated on the processes as well as what all the legal terms relating to the Estate Planning Documents mean. Along the way you will be prompted for information and some of the questions will also get you thinking outside that square!

2.     Clarify - after we look over and consider the information that we have gathered from you, we will arrange to discuss with you via Teams your Estate Planning Document needs, including the different options available to you of how you can achieve what you want for your family and loved ones when you pass. In fact, you can choose the date and time that best suits you for this meeting by choosing the “Estate Planning - Wills” service on our online booking platform.

3.     Prepare - we then go about preparing your Estate Planning documents.

4.     Sign - if local, we arrange a face to face with you within 3 to 5 business days to sign your Estate Planning Documents. If you are out of town, we can send you instructions on how and where to sign the documents.
